Reasonable jury could find officer acted out of vindictiveness Officer denies having conducted or directed strip search A bookings and admissions officer from Elmira, N.Y., must face a lawsuit for allegedly violating a misdemeanor arrestee's rights by subjecting him to a strip search, then delaying his release from jail after he posted bail, the Second Circuit ruled. Officers arrested Christopher Murphy, then 67, on a warrant issued by the Elmira City Court charging him with maintaining a 'structure unfit for human occupancy' in violation of the New York State Property Maintenance Code, and other offenses violating the New York State Fire Code.
